82-Year-Old Holocaust Survivor Told She “Consented” To Sexual Assault By 43-Year-Old Convicted Rapist

A freed sex offender has been acquitted of his most recent rape charges by an Israeli court after the court ruled that there was not enough evidence to suggest the 82-year-old woman hadn’t consented to the sexual interaction.

According to The Times of Israel, on Monday, June 5, the Nazareth District Court cleared 43-year-old Adel Hayeb of all charges related to the horrific rape of an 82-year-old Holocaust survivor.

The woman alleged that Hayeb had introduced himself as a home renovator, and she then invited him into her home to do some work. But once inside, he pushed her into the bedroom and sexually assaulted her.

Following the assault, the victim had to seek emergency medical treatment, and required surgery for bleeding and bruising.

Despite the injuries, a panel of judges found that “it was not proven that the accused raped the complainant without her consent’ or that she had said ‘no’ time and time again.”

Asher Kula, one of the judges presiding over the case, did not believe the 82-year-old woman testified coherently, saying that she “evaded replying to some of the questions, both in the hearing before us and in police questioning.”

Hayeb had previously served 8 years in prison after being found guilty of raping a 70-year-old woman, and had just been freed one year prior to the most recent incident. In a 2022 report, YNet News Israel claimed that Hayeb had over one dozen previous convictions.

Despite his lengthy criminal history, the accused denied all allegations against him, maintaining that his sexual relations with the woman were “consensual.”

Last year, The Jerusalem Post published an article citing statistics from The Association of Rape Crisis Centers in Israel (ARCCI), an organization dedicated to combatting sexual violence in Israel, which claimed most “people imprisoned for sexual crimes will be released before completing their full sentence.”

Although the number of initiated rape and sexual assault cases increased in 2021, as indicated by the ARCCI, the number of indictments filed in Israel has decreased since the year prior.

Disturbingly, one-third of all prisoners serving time for sexual crimes did not attend any sort of mandatory rehabilitation program.

The elderly victim’s attorney on the case, Dorit Ben Avraham, as The Times of Israel notes, admitted to being shocked by the verdict, calling it “a black day for future rape victims.”

Hayeb is scheduled to be released from custody in the coming days.
