Loudoun County Public Schools in Virginia has been hit with a $30 million lawsuit from the parents of the teen girl who was sexually assaulted by a transgender student in the bathroom of their school. The girl’s father has stated that his daughter has struggled academically, emotionally, and physically since the assault at Stone Bridge High School in May 2021.
According to the Daily Mail, Scott Smith, the father of the 15-year-old girl who was raped, is seeking $30 million in compensation from the district for failing to investigate his daughter’s assault and later covering up the horrific incident.
The complaint, filed Wednesday at a federal courthouse in Alexandria, Virginia, accuses former Loudoun County Superintendent Scott Ziegler of lying about the assault in an effort to enshrine a gender inclusivity policy which would allow students to use the washrooms they identified with.
While the school board was debating the proposed transgender-inclusive bathroom plans, Ziegler, who was aware of the girl’s assault, denied that the district had a history of sexual assaults occurring in school bathrooms.
“To my knowledge, we don’t have any record of assaults in our restrooms,” he said.
During that same meeting, Smith confronted the board with an impassioned outburst regarding his daughter’s assault and was subsequently physically removed from the premises by police. He was then charged and convicted of disorderly conduct, but was recently pardoned by Virginia Governor Glenn Youngkin.
In addition to accusing Ziegler of lying and failing to implement preventative measures to ensure the safety of female students in school washrooms, the legal complaint is also accusing “school administrators and lawyers of stonewalling the special grand jury’s investigation” after board members described the trans-identified male student’s skirt as a “kilt.”
Although the lawsuit highlights that the male assailant frequently went by male pronouns and did not identify as female or wear a skirt to access the girls’ bathrooms, administrators were notified about his “disturbing conduct” before the assault. Similarly, the boy’s grandmother warned his probation officer that he was a “sociopath.”
On May 28, 2021, the 15-year-old boy entered the girl’s bathroom at Stone Bridge High School and raped a ninth-grade girl. Soon after, the student was charged with “two counts of forcible sodomy, one count of anal sodomy, and one count of forcible fellatio.”
While the girl’s family was initially told the boy was on house arrest, they later discovered the perpetrator had simply been transferred to another school in the district. In October, the same student was charged with battery and abduction after trapping a female student into an empty classroom against her will and touching her inappropriately.
According to independent pro-woman news outlet Reduxx, after being found guilty of his attacks on two female students, the judge noted that the skirt-wearing teen had “one of the most disturbing psycho-sexual evaluations” she’d ever seen.
“You scare me. What I read in those reports scared me, should scare families and scare society,” she added.
On January 12, 2022, the boy was sentenced to three years in a locked juvenile residential rehabilitation program, with the judge ordering him to register as a sex offender for life upon his 18th birthday.
But weeks later, the judge reversed her decision on the registration requirement. The reason behind the reversal appeared to be technical in nature, with defense attorneys arguing that prosecutors failed to provide a written motion that they would seek to have the teen placed on the registry before the judge made her ruling.
